What is defamation?
Defamation is when an untrue and damaging statement about someone is published which causes serious harm to the reputation of that person. In the context of a business there is a requirement for the defamation to cause financial loss. There are a number of defences to defamation including Truth, Honest Opinion and Public Interest. Publication of a defamatory statement includes messages posted on social media.
What are the consequences of defamation?
Being the subject of a defamatory publication can have a devastating and long term effect. Remedies can include a court order requiring the removal of the offending statement or an injunction preventing the publication in the first place. The courts have the power to award significant damages which aims, so far as money can, to compensate the claimant.
